By accessing or using Release Cadence ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Release Cadence is a product management and feedback collection platform that enables teams to gather customer feedback, manage product roadmaps, and build in public. The Service includes features such as surveys, roadmap management, social media integration, and team collaboration tools.

3. Account Registration

To use the Service, you must:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or guardian.

4. Subscription and Payment

4.1 Plans and Pricing

We offer various subscription plans with different features and usage limits. Current pricing is available on our pricing page. We reserve the right to modify our pricing with 30 days' notice to existing subscribers.

4.2 Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • Payment is processed through our third-party payment processor (Stripe)
  • You authorize us to charge your payment method for all fees
  • All fees are non-refundable except as required by law or stated in our refund policy

4.3 Free Plan

We offer a free plan with limited features and usage. You can upgrade to a paid plan at any time. We reserve the right to modify or discontinue the free plan at any time with reasonable notice.

5. Acceptable Use

You agree not to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights of others
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use the Service to send spam or unsolicited communications
  • Impersonate any person or entity
  • Collect or harvest information about other users
  • Use the Service for any illegal or unauthorized purpose

6. Your Content

6.3 Public Content

Content you designate as public (such as public roadmaps) may be viewed by anyone. You should not include sensitive or confidential information in public content.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Release Cadence and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

8. Third-Party Services

The Service may integrate with third-party services (such as social media platforms). Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for the availability, content, or practices of third-party services.

9. Termination

9.1 By You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

9.2 By Us

We may suspend or terminate your account if you violate these Terms, fail to pay fees, or for any other reason at our discretion. We will provide notice when reasonably possible.

9.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We will retain your data for 90 days to allow you to export it. After 90 days, we may delete your data.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RELEASE CADENCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Release Cadence and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.

13. Data Protection

We process your personal data in accordance with our Privacy Policy. By using the Service, you consent to such processing and warrant that all data provided by you is accurate.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Release Cadence operates, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Release Cadence regarding the Service and supersede all prior agreements and understandings.
